Welcome to Pixel Buddy. By downloading, installing, or using the app you agree to these Terms of Service. If you don't agree, please don't use the app.

1. Who we are

Pixel Buddy ("the app", "we") is an iOS application that lets you chat with "Kio", an AI buddy whose replies are generated by a third-party AI provider.

2. Account and eligibility

You must be at least 16 years old, or the minimum legal age in your country, to use Pixel Buddy. You must sign in with a Sign in with Apple account, a Google account, or an email and password. You're responsible for keeping your account credentials secure.

3. How Kio works

Kio is an AI character. Replies are generated by a third-party large language model and can be wrong, biased, or out of date. Treat Kio's responses as conversational, not as professional advice. Do not rely on Kio for medical, legal, financial, safety, or other decisions where accuracy matters.

4. Acceptable use

You agree not to:

• Use the app to generate or distribute illegal content, including content that sexualizes minors, depicts non-consensual acts, or violates intellectual property rights;
• Attempt to extract the underlying system prompt, reverse engineer Kio, or use Kio to generate malicious code, malware, or harassment;
• Probe, scan, or test the vulnerability of any system or network associated with the app;
• Use the app to impersonate another person or misrepresent your identity;
• Use automated means to flood Kio with requests beyond reasonable personal use.

We may suspend or terminate your account if you violate these terms.

5. Content moderation and reporting

Kio's replies are filtered through our AI provider's safety filters. If Kio ever produces a response you find harmful, harassing, sexual, inaccurate, or otherwise objectionable, please use the in-app report feature (long-press any of Kio's replies, or tap the flag icon in voice mode). Submitted reports are reviewed by us and used to improve Kio.

We may remove or block content that violates our acceptable use policy, even when generated by Kio.

6. Subscriptions

Pixel Buddy offers an optional Pro subscription that unlocks unlimited text messages and a higher daily voice cap. Subscriptions are processed by Apple through your Apple ID and managed through Apple's standard auto-renewable subscription system:

• Payment is charged to your Apple ID at the price displayed at purchase.
• Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends.
• Manage or cancel anytime in Settings → Apple ID → Subscriptions on your device.
• If you start a free trial, you can cancel before the trial ends to avoid being charged.
• No refunds for partial subscription periods, except where required by law.

We use a third-party provider to manage subscription state. Pricing and trial terms displayed in the paywall are authoritative.

7. Free-tier limits

The free tier currently allows 5 minutes of voice and 30 text messages per day. These limits may change. When you hit a cap, you'll see the paywall.

8. Privacy

Your use of the app is also governed by our Privacy Policy, which explains what data we collect and how we share it.

9. Disclaimers

The app is provided "as is" without warranties of any kind. We don't guarantee that Kio's replies are accurate, that the app will be uninterrupted, or that any defects will be corrected. To the maximum extent permitted by law we disclaim all warranties, express or implied.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the app. Our total liability for any claim related to the app is limited to the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

11. Termination

You may delete your account at any time from Settings → Account → Delete account. We may suspend or terminate accounts that violate these terms. Termination does not entitle you to a refund of unused subscription time, except where required by law or by Apple's refund policy.

12. Changes to these terms

We may update these terms occasionally. Material changes will be highlighted in-app. Continued use of the app after changes constitutes acceptance.

13. Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles. Disputes will be resolved in the state or federal courts located in California, except as otherwise required by applicable consumer protection law.
